This paper considers the effect of political liberal principles on the children in society. Specifically, the paper argues that political liberalism faces a problem where parents or other adults want to pass on bizarre or dangerous beliefs to their offspring. This problem arises because in the political liberal framework the only limit on what doctrines a child may acquire is that the child becomes a reasonable citizen. Since this criterion is designed to be lax, this implies children may justly be (...) inculcated with views that may undermine their welfare in later life. This presents political liberals with a dilemma. Ensuring that children are taught appropriate views requires narrowing the scope of political liberal principles, whilst keeping the broad focus of political liberalism brings with it unpalatable consequences when we consider the next generation. Timothy Michael Fowler has argued that, as a consequence of their commitment to neutrality in regard to comprehensive doctrines, political liberals face a dilemma. In essence, the dilemma for political liberals is that either they have to give up their commitment to neutrality (which is an indispensible part of their view), or they have to allow harm to children. Fowler’s case for this dilemma depends on ascribing to political liberals a view which grants parents a great (...) degree of freedom in deciding on the education of their children. I show that ascribing this view to political liberals rests upon a misinterpretation of political liberalism. Since political liberals have access to reasons based upon the interests of children, they need not yield to parent’s wishes about the education of their children. A correct understanding of political liberalism thus shows that political liberals do not face the dilemma envisaged by Fowler. (shrink)

Sister (Sr.) Marie Simone Roach, of the Sisters of St. Martha of Antigonish, Nova Scotia, died at the Motherhouse on 2 July 2016 at the age of 93, leaving behind a rich legacy of theoretical and practical work in the areas of care, caring and nursing ethics. She was a humble soul whose deep and scholarly thinking thrust her onto the global nursing stage where she will forever be tied to a central concept in nursing, caring, through her Six Cs (...) of Caring model. In Canada, she was the lead architect of the Canadian Nurses Association's first code of ethics, and her influence on revisions to it is still profound more than 35 years later. In this paper, four global scholars in nursing and ethics are invited to reflect on Sr. Simone's contribution to nursing and health‐care, and we link her work to nursing and health‐care going forward. This paper considers the place of children within liberal-democratic society and its related political morality. The genesis of the paper is two considerations which are in tension with one another. First, that there must be some point at which children are divided from adults, with children denied the rights which go along with full membership of the liberal community. The justification for the difference in the statue between these two groups must be rooted in some notion of capacities, since these (...) are the only relevant differences between adults and children. Second, that linking an individual's capacities to her status undermines the central liberal commitment of political equality. This dilemma explains what I term the threshold view, which holds that children become adult citizens upon reaching an age of competence and that above this level differences in abilities cease to matter to an individual's status. While this view has attractions, this paper argues that this view must eventually be rejected because of its inability to deal with the actual process of human development. In its place, the paper proposes a modification to this view which sees the threshold constrained by moral demands and applied indirectly to age groups rather than individuals. These constraints preserve the commitment to equality in a way consistent with a plausible view of children's place in society. (shrink)

Political liberalism offers perhaps the most developed and dominant account of justice and legitimacy in the face of disagreement among citizens. A prominent objection states that the view arbitrarily treats differently disagreement about the good, such as on what makes for a good life, and disagreement about justice. In the presence of reasonable disagreement about the good, political liberals argue that the state must be neutral, but they do not suggest a similar response given reasonable disagreement about what justice requires. (...) A leading political liberal, Jonathan Quong, has recently offered a rebuttal to this asymmetry objection. His reply rests on an innovative distinction between justificatory and foundational disagreement. Quong claims that disagreements about justice in a well ordered society are justificatory while disagreements about the good are foundational, and suggests that this fact blocks the asymmetry objection. We assess Quong's solution and argue that it fails to justify legitimate state action on matters of justice but not the good. We conclude that the asymmetry objection continues to undermine political liberalism. (shrink)

Many philosophers, following David Lewis, believe that we should look to counterpart theory, not quantified modal logic, as a means of understanding modal discourse. We argue that this is a mistake. Significant parts of modal discourse involve either implicit or explicit reference to what is actually the case, raising the question of how talk about actuality is to be represented counterpart-theoretically. By considering possible modifications of Lewis's counterpart theory, including actual modifications due to Graeme Forbes and Murali Ramachandran, we argue (...) that no coherent version of counterpart theory can provide a plausible representation of talk about actuality, and so, we conclude, counterpart theory should be rejected. In the current dialogue between two authors with different views on analysis, philosophy, and the use of labels, the leading question is: How should one understand the expression ‘analytic philosophy’? Lewin argues that as there are no generally agreed tenets and methods of what is being called ‘analytic philosophy’, the name is to be replaced by a more specific one or abandoned. Williamson defends the use of this phrase, claiming that it is quite serviceable, as it relates to a broad (...) tradition of influence, while it is not even required to adhere to the method of analysis in any distinctive sense. Lewin counters that, in this case, ‘analytic philosophy’ is too empty. One could heal this by conceptual analysis of ‘analytic philosophy’ — but then Kant, for whom philosophy is inherently analytic, would be a proponent of analytic philosophy. Another option is to follow Ryle’s ideal of a label-free, coherent and honest thinking. As Lewin argues, Williamson’s views seem at least partially to agree with Kant’s conception of the difference between philosophy and history of philosophy as well as empirical analysis and the underlying empirical realism. Williamson replies that he uses ‘analytic philosophy’ in its current meaning, which is not composed of the meanings of ‘analytic’ and ‘philosophy’. The current use is different from the earlier ones and not applicable to Kant. He argues against the transcendental idealism and the coarse-grained distinction between analytic and synthetic and a priori and a posteriori that requires an update. (shrink)

The Dobbs opinion emphasizes that the state’s interest in the fetus extends to “all stages of development.” This essay briefly explores whether state legislators, agencies, and courts could use the “all stages of development” language to expand reproductive surveillance by using novel developments in consumer health technologies to augment those efforts.

Through both an historical and philosophical analysis of the concept of possibility, we show how including both potentiality and actuality as part of the real is both compatible with experience and contributes to solving key problems of fundamental process and emergence. The book is organized into four main sections that incorporate our routes to potentiality: potentiality in modern science [history and philosophy; quantum physics and complexity]; Relational Realism [ontological interpretation of quantum physics; philosophy and logic]; Process Physics [ontological interpretation of (...) relativity theory; physics and philosophy]; on speculative philosophy and physics [limitations and approximations; process philosophy]. We conclude that certain fundamental problems in modern physics require complementary analyses of certain philosophical and metaphysical issues, and that such scholarship reveals intrinsic features and limits of determinism, potentiality and emergence that enable, among others, important progress on the quantum theory of measurement problem and new understandings of emergence. The influential public health ethics framework proposed by Childress et al. includes five “justificatory conditions,” two of which are “necessity” and “least infringement.” While the framework points to important moral values, we argue it is redundant for it to list both necessity and least infringement because they are logically equivalent. However, it is ambiguous whether Childress et al. would endorse this view, or hold the two conditions distinct. This ambiguity has resulted in confusion in public health ethics discussions citing the (...) Childress et al. framework, as demonstrated by debate between Resnik and Wilson and Dawson. We analyse this debate to resolve these ambiguities. Finally, we argue that the necessity/least infringement principle of the Childress et al. framework applies only in cases in which only one intervention is to be implemented to achieve one specific goal. In other cases, it is not essential to require that only the least infringing intervention be implemented. (shrink)

John Tomasi’s Free Market Fairness introduces several powerful arguments in favour of a novel and surprising thesis: the best way to realize Rawls’s principles of justice is a free market society, rather than the arrangements that Rawls himself believed would best promote justice. In this paper, I adduce three arguments against Tomasi. First, I suggest that his view rests on a faulty understanding of what constitutes conventional property rights. Second, I argue that many market solutions generate choices which are not (...) valuable ones for the agent to have to make. Third, I show that many choices created by the market systems Tomasi favours create the illusion that citizens are making their own choices when in fact they are not. I suggest that taken together these three arguments are sufficient to defend Rawlsian institutional arrangements against Tomasi’s challenge. (shrink)

Regardless of how health reform proceeds, we will continue to need public insurance programs to care for the poor, cover health problems not addressed by private insurance, and support the nation's health care infrastructure. This article examines that continuing role.

As we write this paper in spring 2008, many are hopeful that November’s election will open the door to some form of comprehensive health care reform. In all likelihood, we will elect a president who has campaigned to a greater or lesser extent on promises of improving access to health care, improving quality, and reducing costs. Equally important, it seems likely that the 111th Congress is preparing to undertake meaningful health care reform. And perhaps most important, despite recent attention to (...) energy issues and the economy, opinion polls consistently show that the American public continues to rank health care as one of the two or three most important domestic issues in the fall elections and supports comprehensive health care reform. In this paper two different approaches to unification will be compared, Relational Blockworld (RBW) and Hiley’s implicate order. Both approaches are monistic in that they attempt to derive matter and spacetime geometry ‘at once’ in an interdependent and background independent fashion from something underneath both quantum theory and relativity. Hiley’s monism resides in the implicate order via Clifford algebras and is based on process as fundamental while RBW’s monism resides in spacetimematter via path integrals over graphs whereby space, time and (...) matter are co-constructed per a global constraint equation. RBW’s monism therefore resides in being (relational blockworld) while that of Hiley’s resides in becoming (elementary processes). Regarding the derivation of quantum theory and relativity, the promises and pitfalls of both approaches will be elaborated. Finally, special attention will be paid as to how Hiley’s process account might avoid the blockworld implications of relativity and the frozen time problem of canonical quantum gravity. (shrink)

In the wake of the collapse of the Soviet bloc, it is timely to ask what continuing role, if any, the concept of sovereignty can and should play in the emerging "new world order." The aim of _Law, Power, and the Sovereign State_ is both to counter the argument that the end of the sovereign state is close at hand and to bring scholarship on sovereignty into the post-Cold War era. The study assesses sovereignty as status and as power and (...) examines the issue of what precisely constitutes a sovereign state. In determining how a political entity gains sovereignty, the authors introduce the requirements of de facto independence and de jure independence and explore the ambiguities inherent in each. They also examine the political process by which the international community formally confers sovereign status. Fowler and Bunck trace the continuing tension of the "chunk and basket" theories of sovereignty through the history of international sovereignty disputes and conclude by considering the usefulness of sovereignty as a concept in the future study and conduct of international affairs. They find that, despite frequent predictions of its imminent demise, the concept of sovereignty is alive and well as the twentieth century draws to a close. (shrink)

Hydrogen energy systems are being developed to replace fossil fuels–based systems for transportation and stationary application. One of the challenges facing the widespread adoption of hydrogen as an energy vector is the lack of an efficient, economical, and sustainable method of hydrogen production. In the short term, hydrogen produced from fossil fuels will facilitate a transition to the hydrogen economy. In the long term, renewable hydrogen production methods will have to be adopted as resources become scarce, causing the price of (...) fossil fuels to rise. In this work, a number of methods have been considered for the renewable production of solar hydrogen, and thermochemical sulphur-iodine cycles proved to be the most promising. The sulphur-iodine cycles have the highest efficiencies and use widely available reactants with relatively straightforward reaction mechanisms, which make them the most economical and technically feasible option for renewable hydrogen production.
